Injuries to Minors

Injury Representation in Scottsdale, Arizona

When young people between the ages of 1 and 18 are seriously injured or die, it is usually from "accidents" that could and should have been prevented. Automobile crashes and collisions are the leading cause of injury and death to minors, followed by drowning, burns and falls.

Generally speaking, in Arizona if a person is under the age of 18 when injured, a personal injury or wrongful death claim must either: (1) be brought on his behalf by an adult parent or legal guardian; or (2) be brought by the victim directly after he or she attains the age of majority. While the victim is still a minor, the "statute of limitations" is paused; it does not begin running until the victim's 18th birthday.

For example, adults in Arizona have 2 years from the date of an auto collision to file a negligence lawsuit against the other driver who caused the collision and the injuries; and if that adult fails to file with that 2-year timeframe, he forfeits his legal claim. But if a minor is injured in that same incident on his 12th birthday, the 2-year statute of limitations does not even begin to run for another 6 years, when he turns 18.

Therefore, the statute of limitations for filing his claim will not "expire" until his 20th birthday.

Clark Watkin has extensive experience representing accident victims who are minors in connection with many serious and sometimes fatal injuries, including those caused by:

  • Cars and other motor vehicle accidents
  • Drowning
  • Burns and Fireworks
  • Playground equipment
  • Dog bites
  • Traumatic brain injuries

In cases where minor children have suffered serious and catastrophic injuries it is critical that the incidents be fully investigated to determine whether there are any parties who are legally at fault and responsible for paying the sometimes huge expenses likely to be incurred during the minor's lifetime.

If you are the parent, guardian or any other adult who is concerned about the serious injuries or death suffered by a minor, we urge you to contact our office to schedule a confidential and free consultation to discuss the circumstances of your minor's injury or death.
